Torque converter not locking up?!?

So I'm at Spa at the moment. Towing the racecar..
The last few miles my friend was driving so I wasn't paying much attention there was like a rubber burning smell

I drove today and its smells when going up hill and realised the torque converter isn't locking at all. It normally does.
I checked the trans fluid and its black so I'll be changing that when I get home
Is there anything else that would cause this? Solonoid or anything?

Is there a chance is the converter itself?  I don't tend to work or understand auto transmission

Most likely the ATF and the burning is the paper friction plates which turns the ATF black.

I've got Millermatic ATF SPIII WS.
This still the right stuff for my newer model as this was for my pajero 2.8

Yes, the Millermatic WS is actually SP 3+ and 4 and is backwards compatible and can be used in any of the auto boxes.
